These Terms & Conditions (“Terms”) govern all photography services (“Services”) provided by Tony Gledhill Photography (“Photographer”, “we”, “us”, or “our”) to the client (“Client”, “you”, or “your”). By booking our Services, you agree to these terms.
Booking & Payment
A non-refundable booking fee of 50% is required to secure your booking.
The remaining balance must be paid in full 15 days prior to the event/session date, unless otherwise agreed in writing.
Late payments may incur additional charges or result in cancellation of services.

Cancellations & Rescheduling
Cancellations by the Client will result in forfeiture of the booking fee.
If the Client wishes to reschedule, all reasonable efforts will be made to accommodate the new date; however, rescheduling is subject to availability and may incur additional costs.
If we must cancel due to illness, injury, or unforeseen circumstances beyond our control, we will offer a full refund or reschedule at no additional cost.

Liability & Client Responsibility
While the utmost care will be taken with your photographs, in the unlikely event of loss, damage, or failure to deliver images due to circumstances beyond our control (including equipment failure, data loss, or unforeseen accidents), our liability shall be limited to a full refund of all payments received for the affected services.
We are not liable for indirect, incidental, or consequential damages arising from our services, including natural disasters.
The Client is responsible for ensuring any required permissions, permits, or property releases are obtained for the photography location.
The Client acknowledges and accepts full responsibility and liability for themselves, their guests, and any third parties present during the photoshoot.
The Photographer shall not be held liable for any personal injury, property damage, accidents, or incidents that occur before, during, or after the photoshoot.
The Client agrees to indemnify and hold harmless the Photographer from any claims, damages, or expenses arising from the photoshoot.
The Client must make it clearly visible to all during the photoshoot that content, not limited to images, audio and video will be captured before people enter the photoshoot.

Illegal or Prohibited Conduct
The Photographer is not responsible for monitoring or policing the conduct of the Client, their guests, or third parties present at the photoshoot.
If illegal, unlawful, or prohibited activity is captured - whether intentionally or inadvertently - the Photographer shall not be held liable in any way for the recording, storage, or possession of such content.
The Photographer reserves the right to cease services immediately if they become aware of illegal conduct during the shoot, and no refund will be provided.
The Client accepts full liability for any legal consequences arising from their actions or the actions of their guests during the session.

Copyright
All photographs remain the sole intellectual property of Tony Gledhill Photography and are protected under applicable copyright laws.
Unless otherwise agreed in writing, the Photographer retains full copyright ownership of all images.
The Client is granted a personal, non-exclusive, non-transferable licence to use the images for private, non-commercial purposes only.

Commercial Usage
Commercial use of images (including but not limited to marketing, advertising, merchandise, or resale) is not permitted without prior written consent and payment of additional licensing fees.
Any agreed commercial usage rights will be clearly documented in a separate Image Licence Agreement.
The Client may not alter, edit, or manipulate the images in a way that misrepresents the Photographer’s work without express permission.

Editing, re editing and Artistic interpretation
The Photographer will provide edited images at their professional discretion.
The Client may request a round of minor adjustments (e.g., color, exposure, cropping) within 5 working days of delivery at no additional cost.
Any further changes will be subjected to additional cost at an hourly rate. All changes must be agreed before proceeding.
Requests for major edits (e.g., body alterations, background replacements, object removal) or any re-editing beyond the included round of revisions will be subject to additional fees at the Photographer’s current editing rate.
Delivery timelines will be communicated at the time of booking, but delays may occur due to artistic or technical considerations.

Use of AI (Artificial Intelligence)
The Photographer may use AI-based tools for limited purposes such as color correction, noise reduction, retouching, or background enhancement.
The Client acknowledges that AI is a creative tool and final results may vary. The Photographer is not liable for stylistic differences or subjective dissatisfaction with AI-assisted edits.
The Photographer will not use AI to generate or alter likenesses of individuals in a misleading, defamatory, or unethical manner.
If the Client specifically requests AI-generated modifications (e.g., background changes, body reshaping), these will be treated as special edits and may incur additional fees.
By engaging the Photographer, the Client consents to the use of AI technology as part of the editing workflow.

Image Delivery
Digital images will be delivered via agreed delivery methods. This can include delivery methods via online platforms such as google drive, google photos within 15 days  following the session/event.
We are not obliged to store images beyond 90 days after delivery.
RAW/unedited files are not included unless agreed in writing.

Model Release
The Client grants the Photographer permission to use images featuring the Client for portfolio, marketing, and promotional purposes unless the Client provides a written objection prior to the session.

Governing Law
These Terms are governed by and construed in accordance with the laws of the united kingdom
Any disputes shall be resolved exclusively in the courts of the United Kingdom.
Acceptance of Terms
By booking our Services, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
